| Page 213 Jan. 6, 1913. Acting Pres. Morback and "all members present." "First in order was a motion to ratify actions had by the council at other than a regular meeting, pertaining to authorizing Mr. Murdock the road supervisor to corduroy a strip of road lying within the corporate limits, known as the Cowman hill, and which is now almost impassable. Motion prevailed by unanimous vote. "Next in order was reading of recorders report covering business in the court for the past year. Same showing 6 cases handled and fines collected to the amount of $86.40, after deducting expenses of said court leaving a cash balance due the town of $14.50. Upon motion the report was accepted as read. "The following bills were presented, audited by the council and warrants ordered drawn on the treasurer for the several amounts: J.E.Morback, $10.50, balance due for services rendered in recorders office during year of 1912; also J.W.Eldridge was allowed $1.00 on account of a lantrn he claims was loaned town during construction of septic tank, same being put out at nights as a means of danger warning and was stolen. "Preperatory to qualifications of new officers, E.R.Herndon marshal elect made a statement that if the city could not afford to pay him reasonable washes [sic.] for his services he would not accept the position as marshal. Upon some deliberation of the council, it was agreed upon by Mr. Herndon and the council that a new ordinance would be drafted and passed making a stipulation that his wages would be $40.00 per month. "He Mr. Herndon also agreeing that he would give the town ten days of his time each month exclusively should it be required to guard and oversee prisoners while working out fines for the city." L.W.Roellich and J.R.Balding were appointeed by the Chair to audit Treasurers books and report at the next regular meeting. "Motion made and seconded that the bill of Mr.Murdock be allowed and a warrant drawn for same. Motion carried. "A petition was presentd to the Common Council to place lights at the different points designated in petition. "Motion made and seconded that the Recorder take up with the proper officials of the S.P.R.R. the matter of getting a crossing on Washington street. Motion carried. "Motion made a seconded that Mr. Stevens be employed to get the grades from Washington street and Epler Addition. Motion carried. "Motion made and seconded that a committee of three be appointed to investigate the matter of purchasing a fire engine. Also power to act on same. Motion carried. The following committee were appointed to act with the President. W.J.Dodosn and F.C.Lukes. "Motion made and seconded that the bill of Fred J.Epler Town Treasurer be allowed and a warrant be drawn for same. Motion carried. "Motion made to settle for the Chemical engine in three payments of $100.00 in one year, $100.00 in two years and $225.00 in three years, with interest at 6 per cent. "Fred J. "Marshall was ordered to post notices on bridge between Mrs.Smock's residence and Holznagel's blacksmith-shop, to dump no rubbish. "The bill of the News-Sheet for printing warrants was allowed and warrant ordered drawn for same. "The names of Louie Wilson, Ed.L.Brown, Egbert Fonda, P.T.Meeks and M.J.Haynes being presented to the Common Council by Marshall E.R.Herndon to be barred from buying Spiritous or Vinous liquors in the Corporate limits of the Town of Sherwood." "Petition being presented to open Pine street from the R.R. track running south and east to be graded and put in shape by the Town of Sherwood. Petition was discussed by all present. "Motion made and seconded that the street be opened as designated in petition provided the property owners dedicate property to the Town of Sherwood and donate the work. Motion carried. "Motion made and seconded that the Recorder notify the R.R. authorities that Washington Street is graded and ready for use and that the R.R. crossing be put in at once. Motion carried. "Bill of F.J.Epler Town Treasurer, salary for quarter ending March 31, 1913 of $18.70 was allowed and warrant was ordered drawn for same. "Bill for lumber, nails, and labor used for a culvert on Washington Street of $17.74, was allowed and a warrant ordered drawn for same. | Council hears report from Dodson regarding advice on County tax bill that he received from "Dodson & Kindall Attorneys of McMinnville." "All members of the Council agreed that it would be wise to have an attorney to meet with the Council and thoroughly go over the whole case with them at a special called meeting in the near future, before proceeding to commence suit. "On motion of Mr. Roellich Council agreed to meet at 1:30 Tuesday August 5th, to view out a tile drain course from the home of D. Becker to main sewer." Signed by Hall and Balding.

"Just at this period Mr. Balding arrived and took the Chair as A.W.Hall was called away on business. "Council ordered by unanimous vote to employ Attorney Dodson to prepare a claim and present same to County Court, with the understanding that he is to proceed with the case to completion; for which he will receive a fee of $100.00. But in the event that the County Court pays over to the Town the money now due it and the Attorney does not have to fight the case through the courts, then the town is to pay him a fee of $25.00 only, for his services. Roll call showed all present except W.J.Dodson Councilman, and F.J.Epler Treasurer. Meeting called for the purpose of canvassing of returns of election Nov. 4, 1913. On the official ballot being taken finding 65 votes for prohibition, 68 votes against Prohibition, 14 votes for prohibition improperly voted, 8 against prohibition improperly voted and one blank. Report was signed by City Council, Mayor and Recorder and report sent to County Clerk. No further business coming before the Council motion was made we adjourn subject to call of President.
